A ship arrest in a foreign country can become a stressful situation for every crew member. The vessel may be stopped from sailing, the crew may be asked to remain onboard, or some seafarers may be taken for questioning.

A ship may be arrested or detained because of legal, safety, commercial or criminal matters. These may include unpaid port dues, cargo disputes, serious safety failures, pollution, illegal fuel discharge, smuggling, narcotics, firearms or banned goods.
The reason for arrest is very important because every case follows a different process. A commercial dispute may be handled differently from a criminal investigation. The crew should not make guesses and should wait for clear written information from the company or authorities.
The Master should immediately inform the shipowner, ship manager or Designated Person Ashore and follow the company’s emergency procedures. The first report should clearly explain what happened and what instructions were given by the local authorities.
The crew should remain professional and follow lawful instructions. Nobody should hide documents, remove evidence or share unofficial information. Important details such as the port, country, arrest reason, crew condition and names of detained seafarers should be recorded.
The shipowner or RPSL agency should ensure that the Flag State, DG Shipping and the Indian Embassy or Consulate are informed when Indian seafarers are affected. Early reporting helps the authorities understand the situation and coordinate support.
The report should include the ship’s name, IMO number, flag, port, company details and number of Indian seafarers onboard. It should also mention whether the crew is confined to the ship, taken for questioning or placed in custody.
The Indian Embassy or Consulate can provide consular assistance to Indian nationals facing problems abroad. This may include contacting local authorities, arranging consular access, helping families receive verified information and guiding the seafarer about local legal procedures.
The Ministry of External Affairs also provides support through Indian Missions for distressed Indian nationals. The Indian Community Welfare Fund may support eligible persons with boarding, lodging, air travel or legal help in certain cases, based on the applicable conditions.
Sometimes, the ship is stopped but the crew remains onboard. Their movement may be restricted until the authorities complete inspections, investigations or court procedures. The crew may not be allowed shore leave or crew change during this period.
Even when the ship is arrested, the crew still needs food, drinking water, accommodation, medicines and communication support. The shipowner remains responsible for basic crew welfare, while the Embassy, Flag State and other authorities may help if proper support is not being provided.
If a crew member is taken into custody, the matter becomes more serious. The seafarer should remain calm, avoid signing documents that are not understood and request access to a lawyer and the Indian Embassy or Consulate.
The seafarer should provide correct information but should not make false statements or accept blame for something not understood. Foreign legal systems and languages may be different, so proper legal advice is important before answering detailed questions or signing statements.
The shipowner should arrange proper legal support when crew members are involved in a case connected with ship operations. The P&I Club may also become involved because it provides liability cover and support for several maritime claims.
The Indian Embassy may help the seafarer find legal assistance and understand the local process. However, the Embassy cannot cancel the laws of another country or stop a court case. The final decision remains with the local authorities and courts.
The company should continue providing food, water, accommodation, medicines and other basic needs while the crew remains onboard. A ship arrest does not remove the employer’s responsibility to care for seafarers.
If the company fails to provide proper support, the Master or crew should report the problem through official channels. The Indian Embassy, DG Shipping, Flag State and port authorities may need to be informed, especially if food, medical care or crew safety is affected.
Seafarers may not be allowed to leave immediately if local authorities need them as witnesses or if their names are connected with the investigation. Permission for sign-off depends on local law, immigration rules and the court or investigating agency.
When a seafarer is legally free to leave, the company should arrange repatriation according to the contract and applicable maritime rules. The Maritime Labour Convention recognises repatriation as an important right, but it may be delayed when a legal restriction applies.
A ship arrest does not automatically end a seafarer’s employment or remove the right to agreed wages. Salary, leave pay and other benefits will depend on the contract, CBA, employment status and the reason for the delay.
Seafarers should keep wage slips, bank statements, contracts and work records safely. If salary is stopped without a clear reason, the matter should be raised with the company in writing and later reported through the proper grievance process if it remains unresolved.
Foreign legal cases may take weeks, months or even longer because authorities need to check evidence, interview crew members, examine cargo records and follow court procedures. Serious criminal cases generally take longer than normal port or commercial disputes.
Families should understand that the company or Embassy may not be able to give an exact release date. The best approach is to request regular written updates and avoid believing rumours about bail, release, repatriation or the final result.
Every seafarer should keep copies of the passport, CDC, INDOS details, contract, CBA, joining letter and company information. Copies should be stored safely in email, cloud storage or another place that the family can access.
During a ship arrest, crew lists, vessel details, detention notices, port documents and written communication may also become important. The Merchant Shipping Act gives Indian consular officers certain duties connected with Indian seafarers abroad.
Families should ask for the vessel name, port, country, company contact and an official explanation of the situation. One family member should handle communication so that different relatives do not receive or spread different information.
All emails, messages and phone-call details should be saved. If the company does not provide updates, the family may contact the RPSL agency, DG Shipping and the Indian Embassy or Consulate through official channels and provide the seafarer’s complete details.
Rumours can create panic and damage an ongoing case. Crew members should avoid posting photographs, documents, investigation details or personal opinions on social media unless the company or legal adviser confirms that it is safe.
Families should also avoid forwarding unverified messages. Information should come from the company, lawyer, Embassy, DG Shipping or local authority. One incorrect message about arrest, release or criminal charges can create unnecessary fear and confusion.
